Sweatshirt Fitness LLC (“Company”) operates its digital platforms, including this application (“App”) and website (“Website”), using services provided by Wix.com Ltd. (“Wix”). The Privacy Policy governing the App and Website is based on Wix’s original Privacy Policy and is structured, generated, and implemented through Wix’s systems and templates. Sweatshirt Fitness LLC does not design, modify, or independently oversee the Privacy Policy framework provided by Wix.

To the fullest extent permitted by law, Wix assumes all legal responsibility for the design, structure, and security provisions of the Privacy Policy, including but not limited to compliance with applicable data protection laws, security measures, and consumer privacy rights. Any liability arising from deficiencies, misstatements, or non-compliance within the Privacy Policy or data security failures falls solely on Wix. Sweatshirt Fitness LLC disclaims any and all legal responsibility related to the design or enforcement of the Privacy Policy, except as required by law.

The Privacy Policy stated on the Sweatshirt Fitness LLC Website and App may not exactly match Wix’s original Privacy Policy. In any situation where differences exist between the two policies, Wix’s original Privacy Policy shall supersede any conflicting provisions. In any legal action arising from such differences, Wix assumes all legal responsibility, and the terms of the original Wix Privacy Policy shall apply. By using the App or Website, you acknowledge that the Privacy Policy is governed by Wix’s policies and terms of service. For inquiries regarding data security, privacy rights, or compliance, please refer to Wix’s official privacy documentation or contact Wix directly.

Wix.com Ltd., its affiliated companies worldwide, and Sweatshirt Fitness LLC (collectively referred to herein as “Wix and Sweatshirt Fitness,” “we,” “our,” or “us”) care deeply about the privacy of our visitors and users. This Privacy Policy (“Privacy Policy”) describes how Wix and Sweatshirt Fitness collect, use, and share your Personal Information (“PI”), as well as outlines the rights you have in relation to that Personal Information. This Privacy Policy applies to all users of Wix and Sweatshirt Fitness services—including unregistered visitors, registered users, and premium users (collectively, “Users,” “you,” or “your”)—and to all services provided by Wix and Sweatshirt Fitness, including our websites (including www.wix.com, www.bestfitnessli.com, and any of their subdomains, the “Website”), web applications (“Wix Apps”), mobile applications (“Mobile Apps”), and related services (collectively, the “Services”).

Integration with Sweatshirt Fitness LLC Applications

Any application developed by Sweatshirt Fitness LLC and hosted on the Wix platform is subject to this Privacy Policy in its entirety. By accessing or using any Sweatshirt Fitness LLC application hosted via Wix, you expressly acknowledge and agree that the privacy practices described herein govern such application. There is no separate privacy policy for the Sweatshirt Fitness LLC application; the practices and policies of Wix and Sweatshirt Fitness LLC are deemed one and the same, forming a single, legally binding agreement.

This Privacy Policy is not intended to override any contractual terms you may have with us, nor does it limit any rights you may have under other applicable data privacy laws.

2. What ‘Personal Information’ do we collect?

2.1. User Information

To provide you with the Services, we must collect Personal Information relating to an identified or identifiable natural person (“Personal Information”). We collect Personal Information that you provide to us, from your use of the Services, and from other sources. Here are the types of Personal Information we collect about you:

1. Information You Provide Us: When you register for our Services, sign up for any Wix and Sweatshirt Fitness events, subscribe to our blog(s) or newsletter(s), purchase and/or register domain names, or use any of our Services; and/or when you contact us directly via any communication channel (e.g., Wix and Sweatshirt Fitness support tickets, emails), you may provide us with Personal Information such as your name, email address, phone number, payment information (for Users with Paid Services), any details included in your communications with us or with other users on our platform, and Personal Information contained in scanned identification documents (such as an ID card, driver’s license, passport, or official company registration documents).

2. Information We Collect When You Use the Services: When you visit, download, and/or use any of our Services, we may collect aggregated usage information. This includes details such as visitors’ and users’ browsing and ‘click-stream’ activity on the Services, session heatmaps and scroll data, as well as non-identifying Personal Information regarding your device, operating system, internet browser, screen resolution, language and keyboard settings, internet service provider, referring/exit pages, date/time stamps, and similar technical details.

3. Information We Collect from Other Sources: We may also receive Personal Information about you from third-party sources, such as:
   i) security and fraud detection/prevention providers (for example, to help us screen out users associated with fraud);
   ii) social media platforms—if you log in or sign up using your social media account, we may receive Personal Information from that service (e.g., your username and basic profile information). In some cases, we may collect additional Personal Information from lead enhancement companies that help us improve our service offering;
   iii) advertising and marketing partners, in order to monitor, manage, and measure our ad campaigns.

2.2. Users-of-Users’ Personal Information

We may also collect Personal Information pertaining to visitors and users of our Users’ websites or services (“Users-of-Users”), solely on behalf of our Users (as further described in Section 6 below).

2.3. Wix and Sweatshirt Fitness Jobs Applicant Information

We also collect information provided by candidates (“Applicants”) for positions with Wix and Sweatshirt Fitness LLC when they apply to any of the open positions published at https://www.wix.com/jobs, whether by e-mail or through other channels (as further described in our Privacy Policy for Job Applicants).

Disclosure of Information for Business Purposes

In the past 12 months, Wix and Sweatshirt Fitness LLC, including its digital platforms powered by Wix, may have disclosed each of the categories of personal information listed above to our affiliates, Third Party Service Providers, social media platforms, advertising partners, analytics partners, and promotional partners.

 

Sales or Sharing of Your Information

Note: We are not in the business of auctioning off your data to the highest bidder. However, under U.S. privacy laws and regulations, the term "sale" is broadly defined. Wix and Sweatshirt Fitness LLC, through the use of Wix and other service providers, may have "sold" or shared the categories of Personal Information listed above in the past 12 months with our affiliates, Third Party Service Providers, promotional partners, advertising partners, analytics partners, and social media platforms. Wix and Sweatshirt Fitness LLC do not knowingly collect, use, sell, or share the Personal Information of children under the age of 16.

Sensitive Personal Information

Wix and Sweatshirt Fitness LLC may process Sensitive Personal Information in accordance with applicable laws and do not use or disclose such information in a way that would require an opt-out opportunity under applicable laws.

Retention of Information

We retain your Personal Information for the time period reasonably necessary to achieve the purposes described in this Privacy Policy or any other notice provided at the time of collection. To determine the appropriate retention period for Personal Information, Wix and Sweatshirt Fitness LLC consider the amount, nature, and sensitivity of such data, the potential risk of harm from unauthorized use or disclosure, the purposes for which we process it, and the applicable legal requirements.

 

3. Why Do We Collect Such ‘Personal Information’?

We use your Personal Information for the following purposes as part of the combined Wix and Sweatshirt Fitness LLC Services:

• To provide and operate the Services: This includes delivering both Wix and Sweatshirt Fitness LLC offerings to you.

• To further develop, customize, expand, and improve our Services: We refine our combined services based on Users’ common or personal preferences, experiences, and challenges.

• To provide ongoing customer assistance and technical support: Our support teams for both Wix and Sweatshirt Fitness LLC work together to help you.

• To contact our Users with service-related notices and promotional messages: As further detailed in Section 8 below, this includes both general and personalized communications for Wix and Sweatshirt Fitness LLC.

• To update, expand, and analyze our records: This helps us identify new customers and opportunities to improve our combined services.

• To facilitate, sponsor, and offer contests, events, and promotions: We determine participants’ eligibility, monitor performance, contact winners, and grant prizes and benefits for activities conducted under the Wix and Sweatshirt Fitness umbrella.

• To analyze our performance and marketing activities: This enables us to continually refine our joint service offerings.

• To create aggregated statistical data and other aggregated and/or inferred information: We or our business partners may use this information to provide and improve our respective services.

• To provide you with professional assistance: Ensuring a high level of support for both Wix and Sweatshirt Fitness LLC services.

• To enhance our data security and fraud prevention capabilities: Protecting the integrity and safety of the combined services.

• To comply with any applicable laws and regulations: Ensuring that all our practices meet legal and regulatory requirements.

We may use techniques such as “machine learning” (referred to in European law as “automated decision-making”) to help improve our Services. When we use machine learning, we either:

• Involve a human being in the process (so the decision is not fully automated), or

• Apply machine learning in ways that do not have significant privacy implications (for example, reordering how applications might appear when you visit the Wix and Sweatshirt Fitness LLC App Market).
  Additionally, we may use machine learning to help monitor, identify, and suspend accounts sending spam or engaging in abusive or fraudulent activity.

We use your Personal Information for the purposes set out above when:

• Our use of your Personal Information is necessary to perform a contract or to take steps to enter into a contract with you (for example, to provide you with a website builder or to deliver our customer assistance and technical support);

4. How We Share Your ‘Personal Information’

We may share your Personal Information with service providers and others (or otherwise allow them access to it) in the following manners and instances as part of our combined Wix and Sweatshirt Fitness LLC Services:

4.1. Third Party Service Providers

Wix and Sweatshirt Fitness LLC have partnered with a number of selected service providers whose services and solutions complement, facilitate, and enhance our combined offerings. These include hosting and server co-location services, communications and content delivery networks (CDNs), data and cybersecurity services, billing and payment processing services, domain name registrars, fraud detection and prevention services, web analytics, e-mail distribution and monitoring services, session recording and remote access services, performance measurement, data optimization and marketing services, content providers, and our legal and financial advisors (collectively, “Third Party Service Provider(s)”). In the event that we share Personal Information with a Third Party Service Provider that offers AI services, we will ensure that such provider is contractually obligated not to use the data to train or improve its AI models.

4.2. Law Enforcement, Legal Requests, and Duties

Wix and Sweatshirt Fitness LLC may disclose or otherwise allow access to any categories of your Personal Information described in this Privacy Policy pursuant to a legal request—such as a subpoena, legal proceedings, search warrant, or court order—or in compliance with applicable laws, if we have a good faith belief that the law requires us to do so, with or without notice to you.

4.3. Protecting Rights and Safety

Wix and Sweatshirt Fitness LLC may share any categories of your Personal Information if we believe in good faith that such disclosure will help protect the rights, property, or personal safety of Wix and Sweatshirt Fitness LLC, any of our Users, any Users-of-Users, or any member of the general public, with or without notice to you.

4.4. Wix and Sweatshirt Fitness LLC Subsidiaries and Affiliated Companies

We may share your Personal Information internally within our family of companies for the purposes described in this Privacy Policy. For example, we may share your Personal Information with Wix.com Inc., our US-based subsidiary, as part of facilitating and providing you (and your Users-of-Users) with our combined Services. Any sharing of Personal Information by our subsidiaries and affiliated companies located in the European Union, the United Kingdom, or Switzerland with those outside these regions will occur only under an approved transfer mechanism, such as the relevant Standard Contractual Clauses.

4.5. In Connection with a Change in Corporate Control

In the event that Wix and Sweatshirt Fitness LLC or any of our affiliates undergo a change in control—whether through merger, acquisition, or the purchase of substantially all of our assets—your Personal Information may be shared with the parties involved in such a transaction.

4.6. Upon Your Further Direction

Our combined Services enable you, through various techniques, to engage and procure third party services, products, and tools for enhancing your web or mobile sites. This includes, without limitation, applications and widgets offered by third parties through the Wix Website (including the Wix App Market), eCommerce payment providers, and third party designers who may assist you with your website (collectively, “Third Party Services”). If you choose to engage with such Third Party Services, they may have access to and process Personal Information of your Users-of-Users collected through your web or mobile sites. For example:

• a) Framed Pages: Our Services may allow you to integrate Third Party Services directly into your web or mobile sites via page framing techniques (referred to as “Frames”). In these circumstances, the Third Party Services may collect Personal Information from your Users-of-Users.

• b) App Market Developers: We allow third party developers (“Third Party Developer(s)”) to create and offer their own applications through the Wix App Market (“Third Party App(s)”), which you may integrate into your web or mobile sites. Each Third Party Developer is bound by the Wix App Market Partner Agreement, which restricts how such developers may access, store, share, and use the Personal Information you and/or your Users-of-Users provide.

• c) Social Media Features: Our Services may enable you to integrate certain social media features, widgets, and single sign-on functionalities (such as “Facebook Connect” or “Google Sign-in”) into your web or mobile sites. These Social Media Features may collect Personal Information from your Users-of-Users (such as name, alias, unique personal identifiers, online identifiers, IP addresses, email addresses, or similar data) and may be hosted either by a third party or directly on our combined Services.

Please note that in the examples listed above in Section 4.6, Wix and Sweatshirt Fitness LLC act solely as an intermediary platform enabling you to procure the services of such Third Party Services at your discretion. In this role, we disclose information to the Third Party Services on your behalf. We will share your Users-of-Users’ Personal Information with Third Party Services only upon your direction or permission, and we are not responsible for or liable for the processing of such Personal Information by those Third Party Services. Wix and Sweatshirt Fitness LLC do not control and are not responsible for the actions or policies of any Third Party Service, and your use of any Third Party Service is at your own risk. We encourage you to review any privacy policy accompanying a Third Party Service and to contact such service for any clarifications you may need before deciding to install and/or use their services.

5. Where Do We Store/Process Your ‘Personal Information’?

5.1. Data Transfers

Wix and Sweatshirt Fitness LLC process data about individuals worldwide and may transfer your Personal Information outside of your country. Your security, privacy, and confidentiality are our top priorities; therefore, we conduct a rigorous vetting process that assesses the privacy laws in those countries to ensure strong data protection standards.

In order to provide our combined Services, Wix and Sweatshirt Fitness LLC may transfer your Personal Information to our subsidiaries and third-party vendors who are contractually obligated to protect and secure your data.

5.2. EU Adequacy Decision

Your Personal Information may be controlled by Wix.com Ltd. in Israel, which the European Commission considers to offer an adequate level of protection for the Personal Information of EU Member State residents. This arrangement applies equally to the combined services of Wix and Sweatshirt Fitness LLC (see here).

5.3. Data Transfers Outside of the EU/EEA/UK

If you are in Europe, the U.K., or Switzerland, when we transfer your Personal Information to a location outside of Europe, we will make sure that:

(i) there is a level of protection deemed adequate by the European Commission; or
(ii) the relevant Standard Contractual Clauses are in place (i.e., the applicable module of the Standard Contractual Clauses for the transfer of personal data to third countries pursuant to Regulation (E.U.) 2016/679 of the European Parliament and of the Council from June 4, 2021, as available here, and the ICO’s International Data Transfer Addendum to the E.U. Commission Standard Contractual Clauses version B1.0, in force from 21 March 2022, as it is revised under Section ‎‎18 of its Mandatory Clauses); or
(iii) we comply with the Data Privacy Framework as applicable to data transfers to the United States and specified in clause 5.4 below; or
(iv) we use another legally recognized transfer mechanism in the applicable jurisdiction.

When Wix transfers E.U. Personal Information to a third country that the European Commission did not find will adequately protect your information, Wix ensures that it has taken additional measures to comply with the European data protection laws.

 

5.4. Data Privacy Framework

Wix and Sweatshirt Fitness LLC, together with their covered entities—such as DeviantArt, Inc., InkFrog, Inc., Modalyst, Inc., and SpeedTab, Inc.—comply with the Data Privacy Framework (“DPF”), which incorporates the EU-U.S. Data Privacy Framework (“EU-U.S. DPF”), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (“Swiss-U.S. DPF”). These frameworks are established by the U.S. Department of Commerce, the European Commission, the UK Government, and the Swiss Federal Administration regarding the collection, use, and retention of Personal Information transferred from the European Union, the United Kingdom (and Gibraltar), and Switzerland to the United States.
Wix and Sweatshirt Fitness LLC have certified to the U.S. International Trade Administration (ITA) that they adhere to the Data Privacy Framework Principles. In the event of any conflict between the terms in this Policy and the Data Privacy Framework Principles, the latter shall govern. Our commitment to subjecting the Personal Information described in this Policy to the Data Privacy Framework is subject to the enforcement and investigative powers of the United States Federal Trade Commission.

Wix and Sweatshirt Fitness LLC may share Personal Information with third parties under circumstances described in this Policy, subject to obligations under the Data Privacy Framework Principles that extend to third parties acting as our agents. We remain liable if a third party acting as our agent processes Personal Information in a manner inconsistent with this Policy, except where we are not responsible for the underlying event.
In compliance with the Data Privacy Framework Principles, Wix and Sweatshirt Fitness LLC commit to resolving complaints regarding our collection or use of your Personal Information. EU, UK, and Swiss individuals with inquiries or complaints about our Data Privacy Framework policy should first contact us at: privacy@wix.com.
Furthermore, we commit to cooperating with the panel established by the EU Data Protection Authorities (DPAs), the UK Information Commissioner’s Office (ICO), and the Swiss Federal Data Protection and Information Commissioner (FDPIC) regarding unresolved complaints concerning our handling of Personal Data under the EU-U.S. DPF, the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF.
Wix and Sweatshirt Fitness LLC have also committed to referring unresolved Data Privacy Framework complaints to an alternative dispute resolution provider located in the United States. If you have an unresolved privacy or data use concern that has not been addressed satisfactorily, please contact our U.S.-based third-party dispute resolution provider TRUSTe at https://feedback-form.truste.com/watchdog/request for more information or to file a complaint. The services are provided at no cost to you.
If you have such an unresolved complaint, you may also contact the applicable EU Data Protection Authorities free of charge. Wix and Sweatshirt Fitness LLC commit to cooperating with the DPAs and complying with their advice.
Should you not receive timely acknowledgment of your complaint or if it remains unresolved to your satisfaction, you may—under certain conditions described on the Data Privacy Framework website—invoke binding arbitration after exhausting other dispute resolution procedures. For more information on this option, please see Annex I of the Data Privacy Framework Principles.

 

6. Users-of-Users’ ‘Personal Information’

Wix and Sweatshirt Fitness LLC may collect, store, and process certain Personal Information of Users-of-Users (“Users-of-Users Information”) solely on our Users’ behalf and at their direction. For example, each of our Users may import their email contacts from third-party services such as Gmail or otherwise collect and manage contacts via their User Website. Such contacts are stored by Wix and Sweatshirt Fitness LLC on the User’s behalf.
For these purposes, Wix and Sweatshirt Fitness LLC act as a “Processor” and not as the “Controller” (as defined under the European Union General Data Protection Regulation (“GDPR”)) for such Users-of-Users Information. The Users controlling and operating such User Websites are considered the “Controllers” of the Users-of-Users Information and are responsible for complying with all applicable laws and regulations governing its collection and management, including all privacy and data protection laws of relevant jurisdictions.
Processing of Users-of-Users’ Personal Information will take place within the European Union, Israel, or a third country (or specified sectors within such a country) that the European Commission has determined ensures an adequate level of protection. Such processing and any transfers will be conducted in accordance with the applicable Data Processing Addendum – Users (“DPA”). Any transfer to and processing in a third country outside the European Union that does not ensure an adequate level of protection, as determined by the European Commission, shall be conducted under an approved transfer mechanism, as detailed in the DPA.
You, as a User, are responsible for the security, integrity, and authorized usage of Personal Information regarding Users-of-Users, including obtaining necessary consents, permissions, and providing any required data subject rights and fair processing notices for the collection and use of such Personal Information.
Wix and Sweatshirt Fitness LLC do not provide legal advice to Users or their Users-of-Users. However, we recommend that all Users publish and maintain clear and comprehensive privacy policies on their User Websites in compliance with applicable laws and regulations, and that Users-of-Users review these policies carefully to ensure they understand and, where required by law, consent to them.
For more details on how Users-of-Users’ Personal Information may be handled by Wix and Sweatshirt Fitness LLC, please refer to Sections 4, 12, and 13.
If you are a visitor, user, or customer of any of our Users, please note that Wix and Sweatshirt Fitness LLC do not have a direct relationship with Users-of-Users whose Personal Information we process on behalf of our Users. If you wish to make any requests or inquiries regarding your Personal Information, please contact the relevant User directly (as they are the “Controller” of such data). For example, if you wish to access, correct, amend, or delete inaccurate Personal Information processed on behalf of a User, please direct your inquiry to that User. Should a User request Wix and Sweatshirt Fitness LLC to remove any Users-of-Users’ Personal Information, we will comply in a timely manner upon verification and in accordance with applicable law (e.g., within thirty (30) days under the GDPR). Unless otherwise directed by the User, we will retain Users-of-Users’ Personal Information for the period specified in Section 12 below.

Our Users are solely responsible for the legality, security, and integrity of their Users-of-Users’ information. If you are a User-of-User, please contact the site owner directly.

Wix and Sweatshirt Fitness LLC, together with our Third Party Service Providers, use cookies and similar technologies (“Cookies”) to deliver our Services, ensure they function properly, analyze our performance and marketing activities, and personalize your experience. Please note that we do not modify our practices in response to a “Do Not Track” signal in the HTTP header from your browser or mobile application; however, most browsers allow you to control cookies (including whether to accept or block them, and how to remove them). 8. Communications from Wix and Sweatshirt Fitness LLC

8.1. Promotional Messages

We may use your Personal Information to send you promotional content and messages via email, text messages, in-platform notifications, marketing calls, and other forms of communication from Wix and Sweatshirt Fitness LLC or our partners (acting on our behalf). If you do not wish to receive such promotional communications, you may notify us at any time or follow the “unsubscribe” or STOP instructions provided in these messages.

8.2. Service and Billing Messages

Wix and Sweatshirt Fitness LLC may also contact you with important information regarding our Services or your use thereof. For example, we might notify you (using any available communication channel) if a particular Service is temporarily suspended for maintenance; respond to your support ticket or email; send reminders or warnings regarding upcoming or overdue payments for your subscriptions; forward abuse complaints related to your User Website; or alert you to material changes in our Services. It is essential that you can receive these messages; therefore, you cannot opt out of Service and Billing Messages unless you are no longer a user of our combined Services (which can be accomplished by deactivating your account).

 

9. Your Rights in Relation to Your ‘Personal Information’

Wix and Sweatshirt Fitness LLC believe that it is imperative that all users have control over their Personal Information. Depending on your use of our combined Services, you may have the right to:

• Request access to or a copy of your Personal Information,

• Update, amend, or delete your Personal Information,

• Port certain Personal Information to another service,

• Restrict or object to certain uses of your Personal Information (such as direct marketing), and

• Withdraw any consent you have previously provided for processing your Personal Information.
